1. About These Terms

This website, ornatekart.com, is operated by OrnateKart, having its registered address at Katras Bazar near Katras College, Dhanbad, Jharkhand – 828114(“Ornatekart”, “we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of our website and your purchase of any product from us.

By browsing the website, creating an account or placing an order, you agree to these Terms along with our Privacy Policy, Shipping Policy and Returns Policy, which form part of this agreement. If you do not agree, please do not use the website.

2. Eligibility

You must be at least 18 years old and capable of entering a binding contract under Indian law to place an order. If you are younger, you may use the website only with the involvement and consent of a parent or legal guardian, who will be responsible for the order.

3. Using the Website

You agree to use the website only for lawful purposes. You must not:

• Use the website in any way that breaks any law or the rights of others.
• Submit false, misleading or incomplete information, including false identity, address or payment details.
• Attempt to hack, disrupt, overload or gain unauthorised access to the website, its servers or other users’ accounts.
• Upload or transmit viruses, malware or any harmful code.
• Use bots, scrapers or automated tools to copy content, prices or product data.
• Resell our products as a dealer or distributor without our written permission.

4. Our Products

Materials. Ornatekart sells fashion and traditional jewellery. Unless a product page clearly says otherwise:

• “Gold-plated” means a base metal coated with a thin layer of gold-tone plating. It is not solid gold.
• “German Silver” is a base-metal alloy (typically copper, zinc and nickel). It does not contain silver. Where we describe a product as silver, the purity (for example 925) is stated on that product page.
• Pearls, stones and beads may be natural, cultured or imitation, as described on the product page.

Appearance. We try to show colours, sizes and finishes as accurately as possible, but photographs and screens vary. Handcrafted items may differ slightly in shape, shade, stone placement or finish. Dimensions and weights shown are approximate.

Skin sensitivity. Some people are allergic to nickel or other metals. If you have sensitive skin or known metal allergies, please check the product details or contact us before buying. We are not responsible for allergic reactions to jewellery described as base metal.

Plating and wear. Plating is a thin layer and will naturally fade with time, perspiration, perfume, water and friction. This is normal wear and is not a manufacturing defect. Please follow the care instructions on our website or packaging.

5. Prices and Payment

• All prices are shown in Indian Rupees (INR) and are inclusive of applicable taxes (including GST). Shipping charges, if any, are shown at checkout.
• Prices, offers and product availability may change without notice, but the price you see at checkout when you place your order is the price you pay.
• We accept payments through the methods shown at checkout, which may include UPI, debit and credit cards, net banking, wallets and Cash on Delivery (“COD”) where available. Online payments are processed by third-party payment gateways, and we do not store your card details.
• COD may be limited by pincode, order value or order history, and we may ask you to confirm a COD order before dispatch. Repeated refusal of COD orders may result in COD being disabled for your account.

6. Orders and Acceptance

Placing an order is an offer to buy. We accept it when we dispatch the product, and an order confirmation email or message does not by itself guarantee acceptance. We may refuse or cancel an order, and will refund any amount you have paid, in cases such as:

• The product is out of stock or discontinued.
• There is an obvious pricing, description or typographical error.
• We cannot verify your details, or we suspect fraud or misuse.
• We cannot deliver to your location.
• The order appears to be placed by a reseller or in unusually large quantities.

7. Shipping and Delivery

Our Shipping Policy explains delivery charges, timelines and serviceable locations. Delivery dates are estimates and may be affected by courier delays, weather, festivals, strikes or other events outside our control. Ownership and risk in the product pass to you when it is delivered to the address you provided, so please make sure your address and phone number are complete and correct.

We recommend recording a continuous unboxing video when you open your parcel. It helps us resolve damage or wrong-item claims quickly.

8. Returns, Exchanges and Refunds

Returns, exchanges and refunds are governed by our Returns Policy. In general, products must be unused, unworn, in original condition and packaging, and returned within [number] days of delivery. Some items (for example customised pieces, earrings for hygiene reasons, or sale items) may be non-returnable, as stated on the product page and in the Returns Policy.

If you receive a damaged, defective or wrong product, please contact us within [48 hours / number] of delivery with your order number and photos or video. 9. Offers, Coupons and Promotions

Discount codes and promotions are valid only for the period and conditions stated. They have no cash value, cannot be combined unless stated, and may be withdrawn if misused or applied in error. Welcome or first-order offers apply once per customer.

10. Intellectual Property

All content on the website, including the Ornatekart name and logo, product photographs, designs, text, graphics and layouts, belongs to us or our licensors and is protected by Indian and international intellectual property laws. You may not copy, reproduce, edit, republish, sell or use our content for commercial purposes without our prior written permission. You may share our content on social media with credit to Ornatekart for personal, non-commercial purposes.

11. Reviews, Photos and Submissions

If you post a review, photograph, video, social media tag or any other content (“your content”) to us or about us, you confirm that it is yours, lawful and not misleading. You give us a free, non-exclusive, worldwide licence to display, edit and share it on our website, social media pages and marketing, with or without your name or handle. We may remove any content that is abusive, unlawful, fake, off-topic or otherwise objectionable. Reviews must reflect honest experiences, and we do not pay for or alter reviews to change their meaning.

12. Third-Party Links and Services

Our website may link to or use third-party sites and services such as payment gateways, couriers and social media platforms. We do not control them and are not responsible for their content, security or policies. Please read their terms before using them.

14. Communications

By placing an order or creating an account, you agree to receive order updates and service messages by email, SMS, WhatsApp, phone and in-app notifications. With your consent, we may also send you offers, new-arrival announcements and newsletters. You can opt out of marketing messages at any time by using the unsubscribe link, replying STOP, or contacting us. Order-related messages will still be sent while you have an active order.

15. Disclaimer and Limitation of Liability

We work hard to keep the website accurate and available, but we do not guarantee that it will be uninterrupted, error-free or free of harmful components. Except as stated in these Terms and where required by law, the website and products are provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, Ornatekart, its owners, directors, employees and service providers are not liable for any indirect, incidental, special or consequential loss, or for any loss of profit, data or goodwill, arising from your use of the website or products. Our total liability for any claim relating to an order is limited to the amount you paid for that order. Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, or your statutory rights as a consumer.

16. Indemnity

You agree to compensate and hold harmless Ornatekart and its owners, employees and partners against claims, losses and reasonable legal costs arising from your breach of these Terms, your misuse of the website, or your violation of any law or third-party rights.

17. Events Beyond Our Control

We are not responsible for delay or failure to perform caused by events beyond our reasonable control, including natural disasters, lockdowns, strikes, transport disruptions, payment-system or internet outages, or government actions.

18. Termination

You may stop using the website at any time. We may suspend or terminate your access or account if you break these Terms or if we suspect fraud or misuse. Termination does not affect rights and obligations that arose before it, including payments due and the sections that by their nature should continue.

19. General

• Severability: if any part of these Terms is found invalid, the rest remains in effect.
• No waiver: if we do not enforce a right immediately, we do not give it up.
• Entire agreement: these Terms and the policies referred to in them are the complete agreement between you and us about your use of the website.
• Assignment: you may not transfer your rights under these Terms. We may transfer ours as part of a business transfer.

These Terms are governed by the laws of India. Subject to your rights as a consumer, any dispute will first be discussed in good faith through our grievance process below. If it cannot be resolved, the courts at Dhanbad, Jharkhand will have exclusive jurisdiction.
